11 Nov 1850 DECLARATION OF THOMAS LEE

State of Alabama } On this fourth day of November 1850 personally County of Shelby
            &nbs p;              } appeared before Hiram Sumner, J.P., Thomas Lee, aged fifty six years, a resident of said County and State, who declares that he was a private in the Company commanded by Capt. David G. Vance in the --- Regiment of Tennessee Volunteers commanded by Col. John Williams, Battalion under Major Jack Cocke in the War of 1812; that he volunteered at Rogersville, Hawkins County, Tennessee the latter part of November 1812 for 2 months, joined the army and marched on the 6th day of December after Florida against the Seminole Indians, and continued in actual service in said war for the full term of 3 months and was honorably discharged at Knoxville, Tennessee on the 4th day of July 1813 as will appear by the muster rolls of said company, his original certificate of discharge having been lost by the burning of his house. And the said Thomas Lee on oath further declares that he was first corporal on the company commanded by Captain James Cummings in Regiment of Tennessee Volunteers commanded by Col. Blue (Who was a major in the regular service), Battalion under Major John Chiles in War of 1812; that he volunteered at Rogersville, Tennessee sometime in September 1814 for 6 months, was marched on the 8th day of October 1814 to Alabama against the Creek Indians, and continued in actual service for 6 months and was honorably discharged at Rogersville, Tennessee sometime in the summer of the year 1815 as will appear by the muster rolls of said company, his original certificate of discharge having been destroyed by the burning of his house. He makes this declaration for the purpose of obtaining the bounty land to which he may be entitled under Act of September 28, 1850.

Shelby County } Before Hiram Sumner, J.P., comes and makes oath that the above named Thomas Lee served the 6 months last set forth in his declaration as this affiant was in the same company with him during the whole term; and he further states that the statement first made by the said Thomas Lee is true, as affiant lived in the said neighborhood of Rogersville, Tennessee and saw said Lee start with the soldiers and knows he was absent for three months. This was in December, 1812.

State of Alabama } On this 6th day of September 1858 before N. Lee, J.P.
            &nbs p;              } came Sarah Lee aged sixty three years, a resident of said county and state and
Shelby County     } declares she is the widow of Thomas Lee, deceased, who was a private in the company of Mounted Men commanded by one Captain James Cummins in the War with the Creek Indians in the year 1814 and that said Company went from the County of Hawkins, State of Tennessee and from the town of Rogersville sometime during the month of October in the year 1814 as she now believes from her recollection of the same and that said company volunteered as she thinks for the term of six months and that the members of this company with her said husband, Thomas Lee, among them returned to their homes in the County of Hawkins in the state of Tennessee some time in the month of April in the year of 1815 and that said company was as she now believes taken from the State of Tennessee to the Creek or Seminole country in Alabama or Florida and that it was thence taken to Baton Rouge in Louisiana and was there dismissed or sent home in the early part of the said year 1815 and that her husband Thomas Lee was honorably discharged from said service about the time last above mentioned and that her said husband has heretofore drawn a Bounty Land Warrant for one Hundred and Twenty Acres to the best of her recollection and that he drew this Warrant through the agency of John S. Storrs, Esq. or of Warers & Storrs of Montevallo in the State of Alabama and that here said husband drew the Warrant as aforesaid under Act of September 28, 1850 and that she does not know the number or date of this said Warrant for the reason that her said husband, Thomas Lee sold the said Warrant during his lifetime and that she believes the said warrant was located in the Land Office of the U.S. kept at Tuscaloosa, Alabama. Her said husband also served three months in the aforesaid war in the company of Mounted Men under a Captain Vance or Captain Williams or Col. Williams, which company went from the same county of Hawkins in the State of Tennessee. She further states that she was married to the said Thomas Lee in Hawkins County Tennessee in the month of August in the year 1813 by one John Hamlin, a Justice of the Peace and that her said husband died in Shelby County, Alabama on the 5th day of February 1853, and that her name before her said marriage was Sarah Bailey, and that she is now a widow. She makes this declaration for the purpose of obtaining the Bounty Land to which she may be entitled under Act of March 3, 1855

We, Thomas Griffin and Henry R. Lee, residence of the vicinity of Hillsboro Post Office in the County of Shelby, State of Alabama upon our oaths declare that the foregoing declaration was signed and acknowledged by Sarah Lee in our presence; that her said husband died about the time as set forth by her, and that she is still a widow etc. Thomas Griffin H. R. Lee No 10,968 Treasure Dept-3rd Auditor's Office. Washington, D.C. may 30 1851. It appears from documents on file in this office that Thomas Lee served in Capt. David S. Vance's Company of Tennessee Militia entered the service (no time given) on the 1st day of December 1812 and served the 25th day of March 1813 when he was discharged (2nd service). He appears to have reentered the service for 6 months and 26 days under the command of Capt. Hames Cummings, 8th day of October 1814 and served until the 3rd day of May 1815 when he, with his company was "Mustered out of service".

Morrow, Judge of Probate, came Sarah Lee, aged 77, a resident of Shelby County, Alabama and declares she is the widow of Thomas Lee, who served in the War of 1812 (repeats service given before). That she was married under the name of Sarah Bailey to said Thomas Lee on the ___ July 1813 by Esq. John Ham(l)in at Rogersville, Tennessee. Her said husband died at Shelby County, Alabama February 1853. Takes loyalty oath. P.O. Elyton, Jefferson County, Alabama. Place of abode, Shelby County, Alabama 10 miles south of Elyton. Sarah (X) Lee Attest: Samuel Acton and William S. Earnest. Samuel Acton and Thomas N. "Reference is made to your letter in which your request information in regard to Thomas L. Bailey who was killed in the Revolutionary War leaving a widow, Sarah, and the War of 1812 record of Thomas Bailey, who settled in Shelby County, Alabama in about 1815. The Revolutionary War records of this office have been searched and no claim for pension found based upon the service of a Thomas Bailey, as described by you. The surname was searched under similar spellings. The War of 1812 records of Thomas L. Bailey which follow was obtained from papers on file in the claim for bounty land, based upon his service in that war. The date and place of birth of Thomas L. Bailey were not given nor were the names of his parents stated. Thomas L. Bailey volunteered in Rogersville, Hawkins County, Tennessee, served as a private in Captain James Cummings' Company of Tennessee militia, from October 8 1814 until May 3, 1815 marched to alabama against the Creek Indians. Thomas L. Bailey was living in 1850 in Shelby County, Alabama, then aged 53 years. The soldier, Thomas L. Bailey was allowed bounty land in full satisfaction for the service rendered, on his application executed in Jefferson County, Alabama, August 16, 1855. The papers on file in this claim contain no reference to wife or children of Thomas L. Bailey. Thomas Lee of Shelby County, Alabama, in 1850, stated that he was 1st Corporal in the same company with Thomas L. Bailey and "went to the same place". Thomas Bailey, soldier of the Revolution, in which he is said to have been killed. His wife was named Sarah ________. They were the parents of the Following Children, at last:

Thomas Bailey b. 1773 in Virginia m. Zilphia Lee, Daughter of Captain Thomas Lee of Hawkins County, Tennessee Veteran of 1812.
William Bailey ----- Killed in East Tennessee prior to the coming of his family to Alabama. Was Captain, Hawkins County, Tennessee Regiment commissioned August 15, 1797, m. Winifred Lee, Daughter of Captain Thomas Lee of Hawkins County, Tennessee. She was born August 26, 1778. (William Bailey, above, who married Winifred Lee and had the following Children.)

Thomas Lee Bailey, (b. 1797), in Hawkins County Tennessee, m. 1st in Shelby County, Sarah Hail and by her was the father of two children. On June 22, 1822 was married a second time to her sister Betty Hail, by Col. Jack Shackelford, J.P. The Hail family is said to have come from East Tennessee and lived in Shelby County, Alabama. These sisters had one brother, William Hail.

Mar 22 1818),  born in Possum Valley, part of Cahaba Valley, Shelby County, Alabama, son of Thomas Lee and Sarah Bailey, grandson of Winifred Lee and William Bailey, married (m: Feb 15 1844), Susan Jane Acton, (b. Oct 13, 1828), daughter of  Rev. William Acton and Elizabeth Lee. He was a farmer. Enlisted in Co. ---- 20th Alabama. Buried in the Samuel Acton Cemetery near Rocky Ridge Church on the Cahaba River, Jefferson County, Alabama) .

Louise Bailey b. East Tennessee, d. Walker County, Alabama, age 72 m. Aaron Acton (Son of John) Britton Bailey b. in East Tennessee or Virginia, came to Alabama with his brothers and sisters, but removed and died in the Brazos River section of Texas, at a place called "Bailey's Prairie". Hawkins County, Tennessee Regiments commissioned an Ensign October 10, 1800 and a Lieutenant June 16, 1801.

Susan Bailey, who married Needham Lee, Sr., son of Captain Thomas Lee of Hawkins County, Tennessee. As you can see many of the Bailey's and Lee's were cousins. 1.
 

I am satisfied that the THOMAS LEE referred to on pages 63 - 67 of the Alabama Records - Vol. 244, is the grandson of Captain Thomas Lee, who was the Father of the ZILPHA LEE BAILEY, who was the mother of Winifred (Winnie) Bailey Jones.

He was the son of Needham and Susan Bailey Lee. His wife, Sarah Bailey, was the daughter of William (Brother of Thomas Bailey) and Winifred Lee Bailey.

2. In a document dated Feb. 1, 1800, I found that Capt. Thomas Lee was awarded an Army Land Warrant (#2608 4 Apr 1792 - 300 Acres). This is Captain THOMAS LEE, father of ZILPHA LEE BAILEY, who was the mother of Winifred (Winnie) Bailey Jones.

3. According to this record, Captain Thomas Lee, Father of ZILPHA LEE BAILEY, who was the mother of Winifred (Winnie) Bailey Jones had other children (Siblings of ZILPHA LEE BAILEY, who was the mother of Winifred (Winnie) Bailey Jones.)

4. William H. Bailey, son of William Bailey and Nephew of Thomas and Zilpha Lee Bailey, was the father of Joe Bell Bailey, who is believed to have married Cortney Jones, daughter of Nathan O. and Winnie Bailey Jones.
5. We know, according to this recording, that Thomas Bailey's Father was also named Thomas Bailey and his mother's name was Sarah. Thomas Bailey (Grandfather of Winnie) obviously served in the Revolutionary War, and "was said to have been killed".

Thomas Bailey (Father of Winnie) is referred to as "Capt. Thomas Bailey", father of Brittain Bailey, so therefore, it is reasonable to believed that Thomas Bailey (Father of Winnie and Brittain ?) SURELY MUST HAVE BEEN a Capt. in the 1812 War, and it was Thomas Bailey (Grandfather of Winnie Bailey Jones) who was the Captain in the Revolutionary War.

Since he (Winnie's Father) was born in 1773, then he would certainly have been of the appropriate age to serve in the War of 1812, but too young for the Revolutionary War. I will need to search the records further to see what I can find out. I will be searching further into the Revolutionary records concerning Captain Thomas Lee. Also as to the status of Thomas Bailey (Grandfather of Winnie) and Thomas Bailey (Father of Winnie), to see just exactly what their status was and if there are more references made to family members, etc.

Winifred (Winnie) Bailey was born in Shelby County, Alabama in 1821. She was the daughter of Capt. Thomas Bailey (Revolutionary War) and Zilpha (Lee) Bailey, and the Grand-daughter of Capt. Thomas Lee (Revolutionary War) and Mary Bryan (Rains) Bailey. She was the wife of Nathan Jones, and the mother of Mary Louise (Mollie) Jones Moore, (Wife of George Washington Moore) and Martha Frances (Matt) Jones Letson, (Mother of Sudie Letson Moore).

Nathan Jones,  was born in the State of Georgia in 1814. He was the father of Mary Louise (Mollie) Jones Moore, (Wife of George Washington Moore) and Martha Frances (Matt) Jones Letson, (Mother of Sudie Letson Moore) and the husband of Winifred (Winnie) Bailey.
